Terms of Service
1. Agreement
These terms apply when you use the datila mobile app or datila.app. By using datila you agree to them. If you do not, please do not use the app.
datila is operated by Dương Quang Đăng, Đội 7, thôn Bích La Đông, Triệu Thành, Triệu Phong, Quảng Trị 520000, Vietnam. In these terms, “we” and “us” mean the operator named above.
2. Who can use datila
You must be at least 13 years old, or older if that is the age of digital consent where you live. datila is not directed at children.
3. What datila is, and what it is not
datila teaches a language from the very first words: you learn words, then put them into sentences, then read short stories built from them, with short grammar lessons along the way. Courses start at Beginner level; some languages also have an Intermediate level.
For some language pairs, datila also has Challenge: a quiz mode with multiple-choice questions about the language you are learning, from easy to very hard, each with an explanation in your own language. Challenge points, levels, and the weekly leaderboard are for fun only: they are not a measure of your language level, and the leaderboard has no prizes.
datila is not a qualification or exam preparation. It does not award any certificate, and nothing in it is recognised by any educational or governmental body.
Lessons, stories, grammar lessons, and Challenge questions are prepared by our team and reviewed by language specialists before they are released. Explanations you ask for while reading a story — the meaning of a word you tap, or Explain this sentence — are generated by artificial intelligence (AI). They are not reviewed by a person before you see them, and they may sometimes be wrong. We work to keep all content accurate, but we do not guarantee that it is free of error. If something looks wrong, tell us through Settings → Send feedback (in Challenge, Report this question) or at support@datila.app.
4. Purchases
The ad-free plan is a yearly subscription for one language, and it renews automatically every year until you cancel it. It removes ads from that language only, in lessons, games, and Challenge. Each language has its own plan; other languages stay free with ads.
Prices vary by country and are shown by the store before you confirm. Payment is charged to your Google Play or Apple account when you confirm. The subscription renews at the end of each year unless you cancel it at least 24 hours before the current year ends; the store charges the renewal within the 24 hours before that date, and tells you in advance if the price changes. You can cancel at any time in your Google Play or App Store account settings, and you keep the ad-free plan until the end of the year you have paid for. Uninstalling the app or deleting your datila account does not cancel the subscription.
All payments are processed by the Google Play Store or the Apple App Store, and refunds are handled under those stores’ policies — we cannot issue a refund directly. Your subscription is linked to your datila account; on a new device, sign in and use the restore option on the purchase screen.
If you are a consumer in the European Union, the United Kingdom, or another country with an equivalent right, you may be able to withdraw from a purchase within fourteen days. How that right applies to a subscription that starts as soon as you buy it is set by the law where you live and by the store’s terms; nothing here limits it, and store refund policies may be more generous.
5. Your account
Your progress is tied to the Google or Apple account you sign in with. Keep access to that account: if you lose it, we cannot transfer your progress or your purchases to a different one. You may delete your account at any time from Settings → Delete account in the app, as described in the Privacy Policy; doing so permanently removes your progress. It does not cancel an ad-free subscription — cancel that in your Google Play or App Store account.
6. Advertising
Free use of datila is supported by advertising. We serve non-personalized ads only. Where ads may appear is limited by design and described in the Privacy Policy. We are not responsible for the content of third-party advertisements.
7. Acceptable use
You agree not to:
- copy, extract, republish, or redistribute datila’s lessons, images, audio, or explanations;
- reverse-engineer the app or interfere with its servers;
- get around the app’s ads or purchases, for example to remove ads without subscribing to the ad-free plan;
- automate access to our services, or use them to build a competing dataset;
- tamper with Challenge points or the leaderboard, for example with a modified app or automated requests.
8. Ownership
All lesson content, images, audio, explanations, software, and the datila name and logo remain our property or that of our licensors. Using the app gives you a personal, non-transferable, non-exclusive, revocable licence to use it on devices you own or control — it does not transfer any ownership.
9. Availability
datila requires an internet connection. We may change, suspend, or discontinue any part of the service, and we do not guarantee uninterrupted availability. Where a change materially reduces something you have paid for, we will say so in the app.
10. Ending your use of datila
You can stop using datila at any time by deleting your account or uninstalling the app. We may suspend or end your access if you break section 7, or if we are required to by law. Where that happens and you have an ad-free subscription you can no longer use, contact us at support@datila.app and we will help you seek a refund through the store.
11. Disclaimer and liability
datila is provided “as is”, without warranties of any kind to the extent permitted by law. We are not liable for indirect or consequential loss. Where liability cannot be excluded, it is limited to the amount you have paid for datila in the twelve months before the claim.
Nothing here limits rights you have under mandatory consumer law where you live, and nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
12. Changes to these terms
We may update these terms. The “last updated” date changes when we do, and significant changes are announced in the app. Continuing to use datila means you accept the updated terms.
13. Governing law
These terms are governed by the laws of Vietnam, and the courts of that jurisdiction have non-exclusive jurisdiction over any dispute arising from them.
If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your own courts.
14. Additional terms for the Apple App Store
This section applies only if you obtained datila from the Apple App Store, and it prevails over anything inconsistent with it elsewhere in these terms.
- These terms are between you and us only, not with Apple. Apple is not responsible for datila or its content.
- The licence in section 8 is limited to a non-transferable licence to use datila on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for datila. If you need help, contact us at support@datila.app.
- If datila fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to datila, including product liability claims, claims that datila fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law, including in connection with the Health Insurance Portability and Accountability Act where applicable.
- If a third party claims that datila infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple has the right — and is deemed to have accepted the right — to enforce them against you.
